Within this assignment I will be looking at 5 legislatons that work with people who have dementa. I
will also looking at 2 frameworks such as ‘putng people frstt and ‘living with dementat.
Legislatio
The frst legislaton I am going to talk about that looks at working with individuals with dementa is
the ‘Safe Guarding Vulnerable Adults Act 2006t, this is an act that was ‘passed to help avoid harm, or
risk of harm, by preventng people who are deemed unsuitable to work with children and vulnerable
adults from gaining access to them through their workt (Scie.org.uk, 2017). One way this would help
a person with dementa is that it is able to prevent those who have a criminal record wouldntt work
with adults that are seen to be vulnerable in anyway. This is ensured by the ‘introducton of
‘Independent Barring Board. He IBB will maintain the childrents barred list and adultst barred list and
will make decisions about whether an individual should be included in one or both barred listst
(Legislaton.gov.uk, 2017). Another way it helps to support individualts with dementa is though the
introducton of the CRB check this ensures that employees are given ‘informaton about an
individualts criminal records history, which informs their assessments about the individualts
suitability to work with children or vulnerable adultst (Legislaton.gov.uk, 2017). This also is put in
place to ensure that people with convicton do not work with vulnerable adults, this would have an
effect on the dementa patents as it would allow them to feel more safer within their environment
but also families that leave their relatves that have dementa they know that they are in a safe place
where they wontt be abused or taken advantage off.
The second legislaton I am going to talk about that looks at working with individuals with dementa
is ‘The Human Right Actt, this is a legislaton that was passed in the UK In 1998. It ensures that you
have the right to ‘you defend your rights in UK courts and compels public organisatons to treat
everyone equally, with fairness, dignity and respect.t (Anon, 2018). One way that this would help to
support a patent with dementa is as a legislaton it will be able to ‘defend the rights of minority
groups, such as children and young people, people with a disability or mental illness, or those at risk
of homelessness.t (Humanrights4qld.com.au, 2018) this would help an individual with dementa as
iw is allowing them to do things for them self in terms of giving them the right to have a ‘chance to
live in fair, just and equal society.t (Humanrights4qld.com.au, 2018). Furthermore is also allows
people that have dementa from being stereotyped because they are seen to be incapable to do
things and have a voice to fght for the rights that they are proclaimed to be given. This legislaton
helps patents to be protected from our vulnerabilites and stopping people from using it against
them.
The third legislaton that I am going to talk about is ‘The Mental Capacity Actt , this is a legislatons
that looks at protectng and empowering ‘individuals who may lack the mental capacity act to make
their own decisions about their care and treatmentt (Nhs.uk, 2018) One way that this helps to
support individual with dementa is that it looks ta the fact that ‘Everyone has the right to make his
or her own decisionst (Nhs.uk, 2018) for instance if a patent didntt want to take their medicaton as
they feel as though it is making them feel sick they have the right to refuse that medicaton another
example is if a dementa patent was coming to the end of life and didntt want to be brought back.
Another way that this legislaton helps individuals that have dementa is that it focuses on that
individuals needs and ensuring that ‘Individuals must be given help to make a decision themselvest
(Nhs.uk, 2018) by ‘providing the person with informaton in a format that is easier for them to
understand.t (Nhs.uk, 2018).
