,1. Introduction


1.1 Module aims and objectives

This 15 credit Autumn Term undergraduate law module LW593 European Union Law (Kent
Vision reference LAWS5930) is designed to introduce law students to foundational legal
principles of the European Union (EU), a regional international organisation of which the
United Kingdom (UK) was until very recently a member for over 47 years. 1 Notwithstanding
the UK now having left the EU at the end of January 2020, the Union is set to remain an
important economic, political and legal influence for the UK in the future. Whilst it is true
that the UK has now formally given up its EU membership, specifically since 2400 CET on 31
January 2020, it is also correct to note that EU law in various ways is set to continue to have
significant direct as well as indirect influences on the UK’s legal system. Under the terms of
the revised 2019 UK-EU Withdrawal Agreement, EU law continues to apply in the UK until
end of the so-called transition period, namely until 31 December 2020. Moreover, the
withdrawal agreement makes specific provision for the continued application of certain EU
rules in respect of Northern Ireland as well as EU-27 citizens residing in the UK after the
elapse of the transition period. This module will, though, not focus on Brexit but instead on
the core legal principles of the European Union itself.

The EU was originally intended to facilitate and promote trade between its constituent
members as a customs union. Subsequently, its members gradually agreed to increased the
range of policy areas addressed at EU level to include further aspects of economic co-
operation (e.g. consumer, environment, single currency) as well security co-operation (e.g.
criminal justice, political foreign policy). This module will focus on core legal aspects
pertaining to the EU legal order, notably including those concerning the operation of its
internal market.

In addition to equipping students with a sound introductory understanding of key features
of EU law, this module also aims to facilitate and encourage engagement with the subject

, from broader contextual and critical perspectives. It seeks to build on previous knowledge
that students have acquired in LW588 Public Law 1, which has referred to constitutional
issues for the UK arising from the impact of EU law on national parliamentary sovereignty.
Particular emphasis is placed in this LW593 EU Law module on studying the role and impact
of the judicial institution of the Union, the Court of Justice of the EU (CJEU), in determining
the meaning, scope and effects of Union law. As will be explored in the module, the CJEU
has been a pivotal actor in the development of European legal integration.

This module is divided into two main parts:
 Part I: The first part explores the core general foundational legal features of the EU’s
legal system, notably introducing its key objectives, institutions, key legal principles,
the legal impact and significance of Union law for individuals within the member
states as well as the impact of EU fundamental rights protection.
 Part II: The second part of the module focuses on key areas of substantive EU law
relating to the formation and realisation of the single market, (the law relating to the
free movement of goods and persons).
So whilst this module will not formally be focusing in detail (for assessment purposes) on
the legal aspects of the UK’s departure from the EU, periodically reference will also be made
to the state of progress of how the EU and UK are managing the implications of Brexit.
 The information note in section 8 below provides some useful general background
and contextual information about the EU and on Brexit.
 Information about seminars, including relevant core reading for seminar preparation
and seminar questions, is contained in the LW593 Seminar Workbook document
(available on the LW593 moodle page).
Suggested background reading

For those students interested in undertaking some general background general reading on
the European Union, selected reading sources are provided in section 4 (Reading Materials).
Whilst this module does not presuppose any prior knowledge about EU law, it is
recommended that students acquire a broad understanding of the Union’s general political
purposes and historical development in order to enhance their overall understanding.
