EXPLAIN HOW AND WHY A BUSINESS ADHERES TO RECRUITMENT
PROCESSES WHICH ARE ETHICAL AND COMPLY WITH CURRENT
EMPLOYMENT LAW
Introduction
In this assignment, I will explain what ethical and legal considerations are in a
business during its recruitment process. I will also convey the difference
between ethical and legal considerations, how they are legal in a business. Also,
the consequences if not following the ethical and legal consideration.
Explain the terms ethical and legal consideration
The term ethical refers to a set of principles. That guides businesses in deciding
on what is right and wrong. Ethical considerations are seen as a should do then
a must do. Example: you should provide the same questions for each candidate
as it is ethical.
However, Legal considerations all depended on the law. Legal considerations
are something you must do in a business. Examples of laws that must be
followed in a business during the recruitment process are: you must have a free
discrimination process.
Explain the difference between being ethical and being legally compliant.
The Differences between ethical is that with ethical it is something you should be
following such not discriminating people is something you should do. For instinct
you should have a workplace that is diverse you do not have to but it's more
ethical and responsible too. However, with legal complaint is something you must
apply to otherwise consequence would be made as this is by law. For example,
you must pay your workers the minimum wage or London minimum wage
otherwise it breaks the law and is illegal. So, the difference between ethical and
legal is one should be done and one must be done no matter what.
Briefly explain why it is important to follow the law.
It is important to follow the law because if you fail you will face consequences in
a business which can either be financial or even worse closure of a business, so
it is important to follow the law because it keeps you and the business stable and
respectful.
Explain why it is important that a business does the following:
1. Advertises honestly.
It is important to advertise honestly because if you do not advertise the job as it
is clients may not trust the business and that can lead to bad reputation in the
business and if you have bad reputation the business will have a loss in
, employees from the lack of trust. Therefore, less productivity in the business
which could lead to closure of a decline in profits. So therefore, it is important to
advertise honestly otherwise you will lose a big part of a client which is trust.
2. Follows confidentiality laws.
It is very important to follow the confidentiality law as this is about the clients or
persons private information therefore this should be kept with only the business
as why it is important, it will also have important documents which can be used
for fraud activity, so ID taking, it's important you follow the law of keeping it
private otherwise the client may feel unsafe and on edge which isn't a good image
for the business and also is breaking the confidentiality law which you can have
serious consequences of.
3. Uses the same application process for all candidates.
Using the same application process for candidates is especially important
because everyone should be treated the same its ethical to do so and everyone
should be given the same opportunity as others so it is important a business
gives that right to people otherwise people will feel less confident to apply as
they feel treat with less respect.
4. Ask all candidates the same questions.
It is also important to ask the same questions even though you will get either the
same or different answer it is still important as everyone get the right level of
respect and equality in the business without feel out of pocket. It is also more
ethical to do so which can make the business see fair and open.
5.
Ask any applicants if they know anyone that works in the business before they
recruit.
Finally, it is important to know if any applicant knows anyone in the work place
because to see who you know and how you got referred to the job. It is also
important because when you get the job, they want you to feel to confusable so
the person you know will help let you know around and what is where so you do
not feel pressured or unsure because you know the person. Therefore, it is
important to know if an applicant knows someone in the workplace so they can
feel less anxious which makes the workplace seem more reassuring.
(Find screen shots of your business, showing evidence of each of the above).
Discuss the different types of equal opportunities legislation that exists.
EQUAL OPPORTUNITIES LEGISLATION
Explain how your business follows the Equal Opportunity Act 2010 during the
recruitment process.
