VICTIMS CODE- Victim’s Code of Practice for Victims of Crime in accordance with the
Domestic Violence, Crime and Victims Act 2004.
WHAT THE POLICE CAN DO, AND WHAT VICTIMS ARE ENTITLED TO WHEN REPORTING A
CRIME.
Once a victim of an offence reports a crime, this then means they are entitled to various
rights including a confirmation that is written of the report to the police, a reference
number from the crime, the police officer who’s investigating the offence's contact details,
help from the victims-Witness Care Unit through investigations, to be kept informed from
these and the police, this includes the progress of the case e.g, charging decisions,
conviction and sentence etc, right to have property returned and expenses paid and the
right to review of decision meaning that if the cps makes a decision that the victim
disagrees with then they can ask the cps to review their decision e.g, withdrawal of a
charge. The right to be kept informed applies at the appeal stage.
CHILD VICTIMS AND VULNERABLE VICTIMS IN COURT GIVING EVIDENCE & VPS
Children and vulnerable victims are those who are at risk of intimidation, because of this
they can apply for special measures which is extra support or help, and this enables those
people to be able to give evidence in court. With the courts permission, a victim personal
statement (VPS) can be read out, this is in accordance with the Victim Support Act 2006,
this statement can include how the crime physically financially and emotionally affected the
victim and can also include whether they feel intimidated or vulnerable or both and if they
are deciding or thinking about claiming compensation. This can then be read in court if the
victim asks or it can be read for them, before sentencing the court will consider a VPS even
if it's been read or not.
After a crime, a victim is able to claim compensation of one of two sources; one is where
compensation can be ordered for the offender to pay the victim by the court, or secondly a
victim can apply to the Criminal Injuries Compensation Authority which is a government
agency.
VICTIMS' RIGHTS AT THE APPEAL STAGE
After sentencing or acquittal, the appeal stage occurs and the rights of victims are that the
Cps will offer to meet a bereaved victim's family if a homicide has occurred, and if the
defendant is appealing against the sentence, conviction, or both, they will appeal this to the
Court of Appeal. If a family decides to go the court of appeal, any further questions they
have should be answered by a CPS representative.
