P1 The 4 legislative factors that influence health and safety in sport

Health and safety at Work Act
This law ensures that the employers are completely aware of the health and safety act;
understanding the key concepts of it. This law is obliged to everyone, when they are doing a
certain activity; all the employees are secured from the hazards. This law is significant as the
person in charge must ensure the full responsibility of all employees; for rugby players need
to wear gum shield. Also comprehending this law means that all employees are responsible
for their own health and safety, not misusing the equipment’s as instructed and taking care
of others. The purpose of this was to simply ensure the safety of everyone. This also means
that if such circumstances does occur i.e. a footballer getting injured, there should be a
medical staff available to solve the problem.

(RIDDOR) – Reporting Of Injuries, Diseases and Dangerous Occurrences
Regulation
This often involves employees to report work related deaths; specific harm to an employee,
accident just avoided or work related diseases. This law in sports monitors and checks safety
procedures. This law also takes in account that where something terrible happens i.e.
lightning striking the football pitch and no one is injured, but doesn’t result in doing so, it
must be immediately reported within 10 days.

Personal Protective Equipment
This is when employees are to use protective equipment in order to decrease the chances of
getting injured. The equipments in sports may include the following; shin pads, gum shields,
metal – studs. This law also administrates that PPE is appropriate for the work, which is
being accomplished. This law also ensures that it is preserved and stored suitably. This law
also make sure that every footballer for example, wearing correct clothing such as; shin
pads, studs and not wearing any jewellery. This reduces the chances of each individuals of
getting injured.

Fire safety and safety of places of sport act
This law was produced in the result of Bradford City being on fire. This covers the following
areas which are; fire safety, the safety of sports grounds, the safety of stands in sports
grounds, indoor sport licenses. This legislation provides the safety of people from fire. It
provides covered accommodation in stands for spectators. Also the person who qualifies for
the issue of a general study certificate is the person who is responsible for the management
of the ground. The purpose of this was to ensure that all the stadiums had enough fire
escapes in case there was an emergency and all the venues had the appropriate
equipment’s to handle the fire.

Legal factors

 Loco parentis
This is to ensure that there is a legal responsibility of people who are in control of
young children when participating in any sport activities. This may include taking up
the authority of a parents figure for example, a sports coach might need to provide
transport for his students and being with them in difficult situations i.e. if a student is
injured and the coach is present he needs to be there for him until there is a
responsible adult for the student to turn up. This then means the coach is not
responsible any more now. This promotes health and safety in sport due to the fact
that there is someone held responsible for somebody else’s child (delegation
process).


 Civil law
This law deals with all kinds of dispute between individual people and organisations.
For example, in football someone tries damage or vandalise somebody else’s
property. The owner would then try to get the footballer in civil court in order to
receive compensation. This is when the owner tries claim money from the player so
he can repair the damage that was caused. Another scenario may be that a
footballer injuring someone in a sporting environment. This case may lead to high
court.


 Case law
This is when judges make decisions about something without having to acquire
enough evidence about something so therefore he makes the verdict and then gets
recorded. For example, a football player spitting on someone but the FA don’t charge
him for that behaviour because they didn’t see exactly what happened. This is when
a statement created by a judge may become obligatory on later judges which can
depend on how the way new laws or law reform have progressively been brought
through the acts of parliament.

It is obligatory for a participant to approve that he had taken all the possible steps
and procedures in order to reduce or completely eradicate the chances of an
accident occurring on a sports premises, before they can be verified not being guilty,
when an organisation is being prosecuted for injury of players. This means that
