concerning the recognition and establishment of parental rights. In South Africa, the

historical trajectory of parental rights in surrogacy within South Africa, examining how
legal precedents, statutory regulations, and constitutional mandates have shaped the
current legal landscape.
The journey begins with an exploration of the earliest instances of surrogacy and the legal
vacuum that once existed. It then transitions to the pivotal role of the Children’s Act1,
which marked a significant legislative intervention in the regulation of surrogacy. The Act’s
provisions, particularly those in Chapter 19, laid down the foundational legal framework
for acknowledging and protecting the rights of intended parents, irrespective of their
genetic link to the child2.
This historical analysis will delve into the critical court cases that have tested the
boundaries of the Act and the constitutional rights it seeks to uphold. It will also consider
the influence of medico-legal issues and the perspectives of scholars who have
contributed to the discourse on surrogacy in South Africa3. By piecing together, the
legislative reforms, judicial interpretations, and academic commentary, this research will
provide a comprehensive overview of how parental rights in surrogacy have been
historically conceptualized and realized in South African law.
This article will attempt to address the question set out above. An examination of the
applicable common law, as well as the existing legislative framework, will be undertaken.4
