breach of a contract for the supply/sale of goods or
services
&
Analyse the remedies available to a business provider in
the event of breach of a contract for the supply of goods or
services.
Introduction:
In these task it would be analysed different ways of protecting the consumer in cases
of breach of contract for the supply or sale of goods or service against the seller .In
addition it would also be analysed different remedies that could occur in a breach of
contract for the supply of goods or service.
When an agreement is made between the buyer and seller in terms of sale of goods
and supply of service a certain basic provisions are implied by statute in order to
provide protection to buyers. These derives from the Consumer Rights Act 2015.The
Consumer Rights Act 2015 was enforced in October 2015 and is a new version with
some more adds up of the Sale of Goods Act 1979 and the Supply of Goods and
Services Act 1982 where there is a consumer sale.As a result the basic protection is
covering when the seller is not enforceable by law to merchandise any goods ,but if
the those goods are merchandised by description that it would be formed an implied
term which will match with the description. As a result businesses as Vodafone must
be aware of all products that they are merchandising are in a satisfactory quality
which are also fitting the purpose of use by the buyer. If the goods are sold by sample
that it is also formed an implied terms where the products must match with the
sample in quality.Furthermore , in businesses as Vodafone exists some implied
terms where the service plays an important factor as it must be delivered with
reasonable care and skills by framing in the time and where no price is agreed a
reasonable price to be paid.In fact all the above protections are in a form of a
statutory implied terms which means that is strongly linked to Sales of Goods Act
1979 and the Supply of Goods and Services Act 1982 which will make sure that all
the above terms will be present into all contracts that involves sales of products
