Arrest with or without a warrant
An arrest is the removal of a person’s rights and freedom for a limited amount of time. Arrests are
done to;
Interrogate the person to a charge. For example a suspect has been taken into custody to be
asked a series of questions about an incident whether it’s a murder, burglary or even a non-
violent crime like fraud or they may not be even involved in the crime but they’re there for
questioning.
Maintain peace in the community. For example if a person is in possession of a gun the
police will arrest this person to maintain the safety of the public at all times.
Have a DNA Test taken. For example if someone commits a crime and finger prints are left
on the crime scene they can use these finger prints to trace the crime back to the offender.
Return a person to prison if they have recommitted a crime.
Have a person go to court to prove whether they’re guilty or not guilty. The court allows you
defend yourself against a crime you may or may not have committed. Courts are need to
provide justice to a suspect to maintain safety to a town, county or country. For example if
someone has committed a crime like murder he/she will be taken to court to prove whether
he is guilty however before this court hearing there is no proof to whether he/she has
committed the crime.
Differences between arrest made by police officers and an arrest by a private citizen
All Citizens of the United Kingdom are legally allowed to arrest another person. This Right is
given to the public by section 24 of the Police and Criminal evidence act.
Citizen’s Arrest
A member of the public can’t make an arrest if the incident is about to happen for
example seeing somebody looking into a lady’s handbag. Citizens can make an arrest
only if the crime has been committed or is in the process of being committed.
Citizens can only arrest other people if there is a serious offence been committed.
For example a robbery.
Citizens are not advised to carry out arrests if their safety is in danger in which they
should call the police to sort out the matter. For example a criminal is holding a
weapon in response to violence, the police should be called as they have the
knowledge and equipment to sort out the situation.
Police Arrest
The Police can arrest a person if they think a crime is about to be committed, an
example is a suspect carrying a knife on the street as this could lead to them
committing a serious crime.
Police can arrest anyone for any offence
Most arrests are carried out by the police because they are trained and know how to
handle certain dangerous situations such as a person holding a weapon. Therefore
they know how to handle the person holding the weapon to make sure the situation
doesn’t escalate.
