The sterilization act of 1998 provides for the right to be sterilized and the circumstances under
which it can be performed
SECTION 2 - Persons capable of consenting:
Introduction:
1. S 2 provides for persons capable of giving consent to sterilization
S 2 – persons capable of consenting:
S 2(1) = A person may be sterilized if they are capable of consenting and 18 years or above
S 2(2) = A person capable of consenting may not be sterilized without their consent
S 3(a) = Sterilization may be performed on a person who is under the age of 18 years if failure would
jeopardize the persons life or seriously impair their health
S 3(c) = A person may be sterilized if consent is given by a person who is lawfully entitled to give
consent and an independent MP before a panel has consulted with the sterilized person and provided
a written opinion that sterilization is in the best interest of that person
