☆☆Las características esenciales de la Constitución de 1931El proyecto constitucional de 1931 fue resultado de un compromiso entre socialistas y
republicanos de izquierdas,para establecer una república democrática y no confesional.
Recogía una amplia declaración de derechos y de libertades como:
- El sufragio femenino
- Matrimonio civil o el divorcio
- Derecho a una educación primaria obligatoria,laica y gratuita
El texto constitucional se validaba la separación entre iglesia y Estado,la iglesia dejaba de
recibir financiación pública y se establecía una marcada división de poderes.
Las Cortes se convierten en unicamerales y la jefatura de Estado se aplicaba a su vez
en presidente de la República.
Esta Constitución fue aprobada por las Cortes el 9 de diciembre de 1931,con un amplio
apoyo parlamentario.Se trata de una carta magna,democrática,laica y progresista.
Principales características:
● Amplia declaración de derechos y libertades
○ Sufragio universal a mayores de 23,tanto a hombres como a mujeres
(1933)
○ Matrimonio civil,el divorcio y la igualdad de derechos entre hijos legítimos
como ilegítimos
○ Derecho a la educación para todas las personas,las escuelas se convierten
en:
■ Públicas,Gratuitas,mixtas y obligatorias
■ (la asignatura de la religión quedó eliminada)
○ Protección social a los más desfavorecidos:
■ Seguros
■ Desempleo
■ Enfermedad
● Separación de Poderes
○ Poder legislativo: Cortes unicamerales
○ Poder ejecutivo: La jefatura de Estado se aplicaba a su vez en presidente
de la República, además tiene facilidad de disolver la cámara de las Cortes y
es elegido cada 6 años por los diputados
○ Poder judicial: gratuidad de la justicia para los desfavorecidos
● Relaciones Iglesia-Estado
○ Se veta la enseñanza eclesiástica
○ Libertad de culto
● Estructura descentralizada del Estado
En conjunto,la Constitución era de talante progresista y considerada como una de las
más avanzadas y permite el desarrollo de un sistema político abierto de izquierdas y de
derechas.
- Fue rechazada por la Iglesia y la derecha
Pero no impidió su aprobación,Alcala Zamora fue elegido primer presidente de la
República y Manuel Azaña el presidente del Gobierno.
