Law reform has been highly effective in achieving just outcomes regarding young drivers and
the law. It has proven effective relating to the process of getting a licence and night driving,
however slightly ineffective regarding speeding. Most law reform has led to reduced fatalities
and injuries demonstrating effectiveness. Overall, law reform has been highly effective in
regards to young drivers and the law within NSW.

A new concept of justice refers to when there’s a shift in society’s values and beliefs. In
Sydney 2022, 5 young teenagers died due to a speeding accident in a tree. The offender
pleaded guilty and received a minimum of 7 years sentence and maximum of 12 years
sentence. (Sydney Morning Herald) Society was outraged by this decision thus calling for
reform. The Road Trauma Support Group (RTSG) aided in getting justice for the families by
calling for reforms regarding repeat offenders regaining their licence and harsher
punishments for young drivers. A range of protests and media campaigns like ‘young lives to
save’ were held and were recognised by the government. In regards to this, Chris Minns told
the SMH they will be taking action and implementing safer regulations to ensure this never
happens again. In 2024, the Bail Act was reformed which involved harsher penalties and
fines for young drivers. The implementation of this reform has proven effective and
ineffective, it has led to an increased awareness of young drivers to be more careful with
speeding however failed to acknowledge the reform had been going on for years and no
action was taken till a fatality, death could’ve been prevented. Therefore, although the law
was reformed and successful, it failed to achieving just outcomes regarding all young
drivers.

According to the Australian Automobile Association (AAA), young drivers aged 16-25 are 2
times more likely to get into vehicle accidents. This is due to biological issues, the prefrontal
cortex isn’t developed fully until the age of 25. This suggests young drivers aren’t mature
and responsible enough to drive. Over 66% of fatalities and injuries are caused by young
drivers (Australian Government Stats) Society once again was outraged by this decision and
called for reform. It resulted in the development section 38 night driving which stated “young
drivers below the age of 25 cannot drive between 11pm and 5am.” This has been evidently
successful as there was a 6.4% drop in 2018 (AAA) Overall, the amendment was successful
and resulted in less casualties and injuries, meaning reform was effective and successful in
achieving just outcomes.

The mechanisms in achieving just outcomes for law reform concerning young drivers are
highly effective. The main mechanism is the parliament, who pass law reform through bills.
The state government has been effective in introducing laws and regulations, such as the
Road Driving Licence Regulation 2017 (NSW) In the amendment it outlines the process of
achieving a licence. At 16 years old, a multiple choice test is taken and 120 hours of
supervised hours in preparation for the p1 test, at 17 a driving test is taken if an individual
can drive without supervision, at 18 the young driver may take a ‘hazard test’ for a p2
licence. Each licence comes with a set of clear guidelines which outline punishments if they
fail to abide by any rules regarding their respective licence. This has been proven
significantly effective as it allows young drivers to gain the practical and reasoning skills
before they drive. The fatalities and injury rates have dropped significantly since 2008 which
