Vortäuschen einer Straftat - §145 d StGB

I. Tatbestand
1. Objektiver Tatbestand
a) Adressat
= Behörde (§1 IV VwVfG) o. ein zur Entgegennahme von Anzeigen zust. Amtsträger (§158 StPO)
b) Tathandlungen – Vortäuschen
= Hervorrufen, Verstärken oder Umlenken eines unwahren Verdachts, idR durch Behaupten von
Tatsachen, die im konkreten Fall geeignet sind, die Gefahr behördlichen Einschreitens zu begründen
– ausreichend: jede Art der Schaffung einer „manipulierten“ Sachlage
aa) Abs.1 Nr.1
- Bezug = rw. Tat
- verfolgbare Tat iSv §11 I Nr.5 (≠ OWI)
- „andere“ Tat setzt voraus, dass dieser ein anderes Gepräge gegeben wird (hM)
bb) Abs.1 Nr.2
- Bezug = angeblich bevorstehende Tat iSv §126 I (präventiv)
cc) Abs.2 Nr.1
- Bezug = der angeblich Beteiligte einer (tatsächlich begangenen, hM) rw. Tat
– bloßes Ablenken vom wahren Täter nicht ausreichend (hM)
dd) Abs.2 Nr.2
- Bezug = angeblich Beteiligter (wie Nr.1) an einer tatsächlich bevorstehenden Tat gem. §126 I
