(a) Neither monetary liability on the part of, nor cause of action shall rise against a
psychotherapist in failing to protect, or failing to predict and protect, from a patient's
threatened/act of violent behavior, except if the patient communicated to the
psychotherapist a serious threat of physical violence against a reasonably identifiable
victim(s).
(b) Neither monetary liability on the part of, nor cause of action shall rise against a
psychotherapist who, under subdivision (a), discharges their duty to protect by making
reasonable efforts to communicate the patient's threat to the victim(s) and law

California Civil Code 43.92
(c) Amended Legislature adds this subdivision to only change the name of the duty
referenced in this section from duty to warn to duty to protect. No substantiated
change is made, and any duty of a psychotherapist shall not be modified as a result of
the name change.
(d) Amended Legislature adds this subdivision and asks the court to interpret this
section consistent with its interpretation prior to 1/1/13.
