Casus 1
Dhr. Janssens is eigenaar van een schilderij van Karel Appel. Naar aanleiding van de
herinrichting van zijn woning beslist dhr. Janssens om dit schilderij aan zijn buurman, dhr.
Pieters, te verkopen voor een prijs van 20.000 euro. Er wordt afgesproken dat de buurman het
schilderij een week later zal komen ophalen.

Daags nadat hij het schilderij aan zijn buurman heeft verkocht, krijgt dhr. Janssens bezoek
van zijn neef Andreas. Wanneer Andreas het schilderij van Karel Appel in de inkomhal ziet
staan, vraagt dhr. Janssens of hij belangstelling heeft om het schilderij te kopen. Andreas is
meteen enthousiast en koopt het schilderij voor een prijs van 21.000 euro. Hij neemt het
schilderij onmiddellijk mee naar huis.

Wie moet hier als eigenaar van het schilderij worden beschouwd? Buurman Pieters of neef
