DemokratieUmschreibung der Demokratie ist Volksherrschaft, hängt en mit Prinzip der souverränität
direkte Demokratie:
• auch Plebiszitär ,selbst durch Volksversammlung in form von Volksabstimmung Plebiszite
(Staatsgewalt) ausüben
Repräsentative Demokratie:
• souveräne Volk übt indirekt Herrschaft über Vertreter aus
Volkssouveränität
• Staatsgewalt vom Volke, alle staatlichen Organe durch das Volk legitimiert.
• Volkssouveränität drückt sich in Deutschland durch demokratische Wahlen aus.
• Nicht alle Organe direkt durch Volk legitimiert, z:B. Bundestag wählt Bundeskanzler,
Landesparlamente wählen Ministerpräsidenten.
Das Rechtsstaatsprinzip
• bindet Staatsgewalt an geltenden Rechten, schützt, sicher Freiheit der Bürger.
• Gesetze gelten auch für alle Bürger (Rechtsgleichheit)
• kann sich auf Einhaltung verlassen (Rechtssicherheit)
Pluralismus:
• in einer Demokratie viele verschiedene politische zivilgesellschaftliche ,wirtschaftliche,
religiöse Interessengruppen konkurrieren dürfen
• Elemente: Parteien, Verbände, Medien
• alle müssen rechtsstaatliche Verfahrensregeln akzeptieren
Gewaltenteilung:
• drei staatliche Zentralfunktionen
• Gesetzgebung (Legislative) Rechtsprechung (Judikative), Vollziehung (Exekutive)
• Missbrauch von Macht erschwert
• neben horizontale auch vertikale, darunter Eben wie Bund, Bundesländer und Kommunen
Konstitutionalismus:
• Verfassung als verbindliche Rahmen
• Verfassung muss nicht glich bleiben
Achtung der Menschen und Grundrechte:
• Kennzeichen der Demokratie
• universell, allgemeingültig
• beinhalten Persönlichkeitsrechten, Freheits-, wirtscaftliche, soziale und kulturelle
