Contratación en masa
Un empresario puede contratar con terceros (empresarios, consumidores1…). Si lleva a cabo el
contrato al estilo tradicional ese contrato supone que las partes negocien y puntualicen las
cláusulas del contrato.
Hay contratos donde no existe la necesidad de puntualizar o negociar nada, es el caso de los
contratos tipo/en masa.
El empresario usa este tipo de contratos para llevar a cabo la contratación plural con terceras
personas (predispone de un contrato clausulado de forma preestablecida y no todas las
cláusulas son negociadas individualmente, lo quieres o no lo quieres) EJ: suministros,
aseguradoras…


El legislador se encarga de controlar que los clausulados generales no sean opuestos a derecho.


Ley General para la Defensa de los Consumidores y Usuarios (Real Decreto Legislativo
1/2007, de 16 de noviembre)
Utilizaríamos esta ley si una de las partes del contrato es un consumidor


Ley sobre condiciones generales de la contratación (Ley 7/1998, de 13 de abril)
Se hace referencia a los controles que el empresario tiene que asar para utilizar esas cláusulas
y regula y controla que sean correctas.


Ambas se encargan de proteger a la parte adherente de los contratos tipo
