1.1 (a) Two Possible Classifications Under the Films and
Publications Act 65 of 1996
1. "X18" Classification:
o When Awarded: This classification is given to
publications that contain explicit sexual content that
is intended for adult audiences (18 years and older)
and may include explicit sexual acts or pornographic
material. Such content is restricted and can only be
distributed in a controlled environment, such as in
adult stores with restricted access to minors.
, 2. "PG" (Parental Guidance) Classification:
o When Awarded: This classification is awarded to
publications that may contain material that is not
suitable for young children without the guidance of a
parent or guardian. The content might include mild
violence, mild language, or themes that could require
parental interpretation or explanation to younger
audiences.
1.1 (b) Virtual Child Pornography and Its Legal Position
Virtual Child Pornography: Virtual child pornography
refers to images, videos, or other digital representations
that depict children or child-like figures engaged in sexual
activities, but where no real children are involved in the
creation of the content. This can include computer-
generated images or animations.
Legal Position: The legal stance on virtual child
pornography varies by jurisdiction, but in many countries,
including South Africa, it is considered illegal. The rationale
is that even if no real children are harmed in the
production of such content, it still perpetuates harmful
ideas and could encourage or normalize child exploitation.
Under the Films and Publications Act, such content would
be prohibited, and the production, distribution, or
possession of virtual child pornography is a criminal
offense.
