Instructions: Answer the four questions below in 150-200-words each. Include a minimum
of one credible source to support your response for each question.
1. Refer back to Lecture 3, Madison’s letter, McCulloch v. Maryland, and Article VI of the U.S.
Constitution from Topic 3 to answer this question.
Explain how sovereignty in the United States is “popular” in terms of “We the People” being the
source of that sovereignty. Also analyze how ultimate sovereign power is apportioned between
the national government and the states. In other words, how was the issue of “imperium in
imperio” handled by the Founding Fathers?
The popular phrase “We the People” is one amongst Americans due to the significance that
comes with it. These words empower the citizens of the United States of America and make it
clear that we live in a sovereignty provided world for our government. “ A dependence on the
people is, no doubt, the primary control on the government; but experience has taught mankind
the necessity of auxiliary precautions” (Madison, 1788). Our founding fathers knew, realized,
and understood that ultimately humans could be corrupted by power, and if not a form of
government would not be needed. From the moment that the Declaration of Independence was
being created, the creators had foreseen the corruption that could come before us, onto us. So it
was understood that the only way for the American government to not be corrupted as the empire
that had just been revolted against, was just to allow the power to be within the people, its
people. Within the letter written by James Madison to George Washington, it was explained with
great detail on how an issue with “Imperium in Imperio” within his view. In this letter MAdison
concludes that “We the People” have the power to elect a federal government which would be
the supreme sovereign, allowing the states to have a secondary hand.


2. In November 2014 the voters of Arizona passed Proposition 122, which says in its brief
operative phrase:
Proposition 122 “permits the state to exercise its sovereign authority by restricting state
and local government personnel and financial resources to purposes that are consistent
with the U.S. Constitution.”
Is Arizona’s Proposition 122 an issue of “imperium in imperio”? If so, how can you tell?
Proposition 122 speaks of Arizona’s “sovereign authority.” Does this authority extend to the
state being the ultimate arbiter of what is “constitutional” regarding the federal constitution?
Explain your answer.

After reading into Proposition 122, I have to disagree with it being an issue of “Imperium in
Imperio”. Proposition 122 states “restricting state and local government personnel and financial
resources to purposes that are consistent with the U.S. Constitution” (Proposition 122). This
