Subject: Memorandum of Law: The Constitution as Fundamental Law– Emmanuel Goldman
Issue
The government has decided to charge Mr. Daniel Goldman with treason, due to his frequent rejection in
regards to the United States Constitution in view of it being the “Supreme”, “Law of Land”. With his rejection
being in stance over the United States regarding the area referred to as the Capital Hill Autonomous Zone. The
argument being made by Mr. Goldman is that “ We the People” is the source of ultimate sovereign power
within the United States. The belief of “We the People” should permit the rejection of the United States
Constitution giving favor of individual autonomy and freedom.
Facts
The Capitol Hill Autonomous Zone (CHAZ) is located in the area of the Capitol HIll neighborhood, the
measurement CHAZ is within a six block radius; this declaration happened during the protests that took place
over the death of George Floyd.
Within the United States Constitution the supremacy clause being talked about can be found under Article VI,
Paragraph 2: “This constitution and the laws of the United States which shall be made in pursuance thereof; and
all treaties made, under the Authority of the United State, shall be the Supreme Law of the Land; and the Judges
in every state shall be bound thereby, anything in the Constitution or Laws of any state to the contrary
notwithstanding”. Within this article the understanding that the Constitution Law and Federal Law are above
State Law and State Constitution, this article however does not allow the Federal government to review or veto
state laws before taking effect. It also does not allow states to go against the Federal government
(Jurkoski,2017,Supremacy Clause).
“We the People” maintains itself as the source of ultimate sovereign power within the United States of
America, since the creation of the Declaration of Independence the first paragraph also states the term “ One
People” in joining together in dissolving the ties between our Nation and that of Great Britain. Pertaining to
same paragraph it also states “... and to assume among the powers of the earth, the separation and equal station
to which the laws of Nature and Nature’s God entitle them a decent respect to the opinions of mankind requires
that they should declare the causes which impel them to separation” (Jefferson). The usage of the term “one
people” was meant to be understood as coming together to take back their natural rights that were rightfully
theirs.
