concerning the explanation prevention control treatment of crime,
delinquency, offenders and victims, including the measurement &
detection of crime, legislation and practise of criminal law, law
enforcement and judicial and correctional systems”
Criminaliteit 2 grote stromingen :
1) Traditionele criminaliteitsdefinitie:
• Verwijst naar de norm
• Daarom ook normatieve criminaliteitsdefinitie
• Criminaliteit is een eigenschap van gedrag
2) Kritische criminaliteitsdefinitie
• Reactieve definitie
• Criminaliteit is eigenschap van maatschappelijke reactie

misdaaddefinitie
① Strafrechtelijke definitie
Norm = strafrecht
Criminaliteit = elke overtreding van het strafwet
die geldt in bepaald land + op bepaald tijdstip
(niet in termen van immorele of antisociale
gedragingen)
Gedrag verboden door strafwet
Strafwet bepaalt wat criminaliteit is en wat niet

→ Strafrechtelijke invulling is te beperkt
→ Deviant gedrag = gedrag dat antisociaal is
een juridische sanctie aangekoppeld wordt
Traditionele criminaliteitsdefinitie (norm!) - Naturalistische
misdaaddefinitie:
Verzet zich tegen niet-universele basis van het recht
Garofalo = op zoek naar universele definitie van criminaliteit:
→ Algemeen geldende definitie
→ Criminaliteit: handelingen die altijd en overal als crimineel
worden beschouwd = natuurlijk misdrijf (in eenzelfde
gemeenschappelijke natuurlijke wetmatigheid)
→ Morele sentimenten als norm (Gemiddelde altruïstische
gevoelens, e.g. Medelijden & eerlijkheid)
→ Morele sentimenten = medelijden (pité) + eerlijkheid (probité)
= gevoelens zorgen ervoor dat er geen misdrijf plaatsvinden,
toch inbreuken = criminaliteit

misdaaddefinitie;
Verzet zich tegen niet-universele basis van het recht
Immers – politieke formaties ontwikkelen SR-regels en deze
veranderen in tijd & ruimte = strafrechtelijke definitie kan geen
beginsel zijn voor criminologie
