Applied Labour Relations Management Competencies

1. STRIKES (15 Marks)

The case study presents the dismissal of Pick n Pay workers who were accused of
participating in a strike at a distribution center in Philippi, Cape Town. The key issue is
to determine whether the workers' actions can legally be classified as a strike under
South African labor law, particularly the Labour Relations Act (LRA) of 1995.

Definition of a Strike (Labour Relations Act):

Section 213 of the LRA defines a strike as:

 "The partial or complete concerted refusal to work, or the retardation or
obstruction of work by persons employed by the same employer, for the purpose
of remedying a grievance or resolving a dispute in respect of any matter of
mutual interest between employer and employee."

For the workers' actions to be deemed a strike, their refusal to work must be collective,
aimed at addressing a grievance or dispute related to their employment conditions, and
deliberate in nature.
