-To serve as a court of last resort that can investigate, prosecute and punish the
perpetrators of the most serious crimes of international concern
-To assist national judiciaries in investigating and prosecuting the worst perpetrators
-To exercise its Jurisdiction only in certain circumstances
-To promote international peace and security by deferring future perpetrators
The ICC can only exercise its jurisdiction in some circumstances. What are they? -
answer -The accused is a national of a State Party or a State otherwise accepting
the Jurisdiction of the court
-The crime took place on the territory of a state party or a state otherwise accepting the
jurisdiction of the court
-The UN SC has referred the situation to the Prosecutor' irrespective of the nationality of
the accused of the location of the crime (situation in Sudan and Libya)
What is the POWER of the ICC? - answer It has the power to exercise its jurisdiction
over persons for the most serious crimes of international concern.
It can hold, prosecute and convict perpetrators
(In 2012 in DRC Thomas Lubanga Dyilo a conolese rebel leader had been committing
war crimes enlisting and conscripting child soldiers and using them in the armed conflict
in DRC b/w 2002 and 2013. The ICC convicted him to 14 yrs in 2012)
What are some limitations to the power of the ICC? - answer -The court can only try
crimes commited after 1 July 2002 when the Statute entered into force
-The lack of willingness some states have to becoming party to the statute
-The accused needs to be transferred to the Hauge by the state
