Custodial Versus Non-custodial Parents - ANSWER Custodial Parent:
Child lives with them

Non-Custodial Parent: Child does not live with them but they still have
LEGAL CUSTODY!!

Both custodial and non-custodial parents have the right to review their
child's treatment records.

Example: Parents who share legal custody of a 10-year-old child. What
are their rights regarding mental health care decisions? - ANSWER
Either parent ALONE may consent to treatment before treatment begins.

Exception: The order outlining their joint legal custody has language to
the contrary

It is recommended that a psychologist request a copy of the custody
order to confirm the status of legal custody of the minor, as well as
review any specific language that may impact the treatment

Example: A psychologist is seeing a child in therapy. The child was
recently removed from parents' custody. The parents send the
psychologist a written request for a summary of the child's records. What
should the psychologist do? - ANSWER Do not send the records.

Per CA Laws and Regulations Code - a psychotherapist who knows a
minor has been removed from the custody of their parents or guardian

, shall not release the mental health records of the minor and shall not
disclose mental health information about the patient based upon
authorization to release those records signed by the minor's
parents/guardians.

Sexual Intimacies with client's close relative, guardian, or significant
other - ANSWER CURRENT CLIENTS: PROHIBITED! Close relatives,
guardians, or significant others.

FORMER CLIENTS: Not prohibited. Okay to have sexual intimacies with
relatives or former clients. Cannot terminate therapy to circumnavigate
this.

Example: A psychologist is treating a child for aggressive behavior at
school. The psychologist receives a letter from the school principal
requesting a copy of the child's treatment records. The request includes
a signed ROI from the parents. What should the psychologist do? -
ANSWER Send the portion of the treatment records that is relevant to
the child's school behavior.

"Psychologists should include in written and oral reports and
consultations only information germane to the purpose for which the
communication is made"

What happens when a licentiate fails to comply with the Board of
Psychology's orders? - ANSWER A licentiate's failure to comply with the
Board's order "shall constitute ground for the SUSPENSION or
REVOCATION of the licentiate's certificate or license"

What is the penalty from the Board of Psychology when a psychologist is
found to be engaging in sexual activity with a current client? - ANSWER
The BoP will REVOKE the psychologist's license.

"When a finding of sexual misconduct occurs, revocation or surrender of
the license/registration and/or denial of an application for license or
registration MUST be the penalty ordered. NO MINIMUM PENALTY"
