Gedaagde College van Beroep voor de Examens van de Erasmus Universiteit Rotterdam
(CBE)

Essentie Student krijgt puntenvermindering ivm aanwezigheidsplicht. Zijn bezwaar is
afgewezen door CBE. Student beargumenteerd dat het legaliteitsbeginsel is
geschonden. CBHO gaat hierin mee.

Rechtsvraag Is de punten toewijzing van de examinator in strijd met het legaliteitsbeginsel?

Feiten - Een examinator heeft aanwezigheidsplicht als onderdeel van eindcijfer
- In de OER staat niks over aanwezigheidsplicht als onderdeel van een
tentamencijfer.

Relevante wetsartikel(en) - Art. 7.3, eerste lid WHW
- Art. 7.10, eerste lid, WHW
- Art. 7.12b, eerste lid, WHW
- Art. 7.13 WHW

Overwegingen - Op grond van art. 7.12c, eerste lid WHW heeft de examinator
bevoegdheid om tentamens af te nemen.
- Op basis van art. 32 OER mag de examinator niet afwijken van de daar
gestelde tentamens.
- Aanwezigheidsplicht staat niet vermeld als tentamen.
- Aanwezigheidsplicht kan niet gekenmerkt worden als een mondeling
tentamen omdat tijdens een college je niet verplicht bent iets te zeggen.

Beslissing Het beroep wordt gegrond verklaard. Beslissing van examinator wordt vernietigd
en moet binnen 2 weken een nieuw cijfer geven.

Leerstuk Hierin wordt duidelijk wat het legaliteitsbeginsel inhoudt. het moet duidelijk zijn
wat de burger kan verwachten.
