De verhouding tussen het staatsrecht en het bestuursrecht
uitleggen;
Staatsrecht= verhouding tussen bestuursorganen en organisatie van het
openbaar bestuur
Bestuursrecht = Bestaat om de burger te beschermen tegen de overheid
De betekenis van verdragen en de Grondwet voor de Nederlandse
rechtsorde uitleggen;
Verdrag= overeenkomst tussen 2 of meer staten
Bepalingen in een verdrag:
1. Instructie normen
Richt zich op de overheid
Geeft tijdbepaling waarbinnen iets/een regel in de nationale
wetgeving moet worden opgenomen
2. Self-executing-normen
Directe wetgeving
Richt zich direct op de burger
Wordt verwacht meteen toegepast te worden in nationale
wetgeving, kan je dus ook meteen op beroepen wanneer het
ingaat
Grondwet
Klassieke grondrechten-> mogen niet aangeraakt worden door de
overheid
, Sociale grondrechten-> gaat om politieke idealen die als zeer belangrijk
worden beschouwd
De spreiding van machten uitleggen;
Het systeem van gelede normstelling uitleggen.
Algemene regels worden ondersteund door bijzondere wetgeving. Voor het
toepassen van een rechtsregel moet je verschillende wetsartikelen in
combinatie met elkaar toepassen.
