BMGT380 - Exam one Cases
Bad Frog Brewery v. New York State Liquor Authority - ✔️✔️Has to do with alcohol
advertising. Label depicts a frog giving the finger. Being regulated by the NY state liquor
authority. Courts say that the authority wins, shield minors. Appealed and was found in
favor of Bad Frog; applies the 3 factors of controlling advertising, say there are less
restrictive ways to shield minors from vulgarity, and there is no indication that banning
the ad will reduce consumption.

Granholm v. Heald - ✔️✔️Two lawsuits; state was restricting an out-of-state company
from selling in their state direct to consumers (2 laws both in Michigan and New York).
Went up to the supreme court.
-States were claiming that they were trying to protect those who were underage from
buying, and the Supreme Court was deciding if this was unconstitutional.
-They found that it wasn't constitutional as there were other things the states could do to
not discriminate commerce from out of state.

Gonzales v. Raich - ✔️✔️2 had medical marijuana plants, and the plants were
destroyed by the DEA. The controlled substances act sets up a 5-tier classification of
drugs, weed being a class 1, totally illegal to manufacture, etc. California allowed
medicinal use earliest, and there was a conflict between Cali and the Federal Gov. They
wanted to prevent the DEA from enforcing the act, which went up to the Supreme Court.
The court had to decide if under the commerce clause could the Fed. control this purely
intrastate activity. Decided that the clause was allowed to be enforced because their
action could impact the national market.
Takeaway: If a purely intrastate activity has the large possibility of impacting the market,
congress can regulate it.

Matthews vs. Eldridge - ✔️✔️Guy was getting social security disability benefits, the gov
cut him off, and didn't give him a hearing. The Supreme Court says he's not entitled to a
hearing because he got the equivalent, which was in his case a doctor's report (unclear
if it was one or more) showing that he was no longer disabled. Whole point is: you're not
always entitled to an actual hearing as long as you get the equivalent of a hearing.

Burger King v. Rudzewicz - ✔️✔️Case: Guys stopped making payments to Burger King
after they were told to vacate the premises. Continued to work and sell.
Issue at hand: Supreme court must decide if there is personal jurisdiction. They find that
this is true because of the long-arm statute in Florida. Contract said that they would pay
to Burger King in Florida, making in personam jurisdiction and enough of a connection
