1. NIET reageren
Wanneer de buur ertegen bouwt, blijft het de eigen muur. Bij geen reactie
blijft het een eigen muur. Er wordt wel een bezits aanmatiging gedaan
door de andere buur. Hij kan dat 30 jaar volhouden, dan wordt het een
gemene muur. VERJARING. De muur verandert van statuut zonder dat er
iets aan te pas komt. Er is ook GEEN vergoeding.
2. WEL reageren
Art 3.108 BW gedwongen aankoop van mandeligheid.

Als de redelijk termijn voorbij is en de buur reageert niet, dan kan men
naar de rechtbank gaan. Het statuut van de muur wordt gemeen. (Niet bij
uitspraak van de rechtbank, pas als de vergoeding wordt betaald) Wel op
bevel van de rechtbank.
