Het strafmaximum van artikel 5 WVW 1994 word verhoogd naar zes maanden hechtenis of geldboete van de
derde categorie. Daarmee zal zijn voorzien in de mogelijkheid voor een passende bestraffing voor die gevallen
waarin de bestuurder een buitengewoon ernstig verwijt kan worden gemaakt terwijl het gevaarlijke
verkeersgedrag – door het niet optreden van schade of letsel – geen overtreding van artikel 6 WVW 1994
oplevert en evenmin een overtreding zou opleveren van het hierna te bespreken nieuwe artikel 5a WVW 1994.
