sheaves. The alleged breach is of the implied term that sheaves supplied by the Defendant would be of
satisfactory quality. The Defendant defends on the basis that the goods were of satisfactory quality and
that, instead, it was the fault of the Claimant and reasons unconnected that the elevators
malfunctioned. Would you like a summary of the facts?
• Master, the claimant seeks summary judgment on the basis that, under Civil Procedure Rule 24.2, the
Defendant has no real prospect of successfully defending the claim and there is no other compelling
