Number of questions: 3 questions with subquestions
Requirement: All questions and subquestions must be answered in order to
obtain the full points.
Point distribution: A total of 30 points can be obtained. 10 points in total for each
question. The maximum amount of points that can be obtained
for each subquestion will be indicated in the exam. The final
mark for the entire exam will be calculated by dividing the
points obtained by three and rounding up or down to a whole
number in the usual manner.
General instructions
- Type your answer to the exam questions in a word document and use the format that
is provided for on Student Portal.
- Every question should be answered in a separate Word document and uploaded in a
separate submission point on Student Portal. You will find a submission point for
each question.
- The file name for each question should have the following format: <ResitExam
CCL.Questionx.ixxxxxx>, Questionx means that you indicate the question you are
answering, ixxxxxx means that you indicate your student number.
- You may use a maximum of 1000 words per question. However, this does not mean
that you will need all of these words in order to give the correct answer. We want to
give you sufficient room for your answer, therefore we set a generous word limit.
However, note that good answers can also be short. Avoid unnecessary long
answers. You will find that some questions require a short answer whereas others
may need some more explanation.
- The takehome exam is an individual exam. You are not allowed to discuss the exam
or your answers with fellow students or others. Group work is prohibited. The rules
on plagiarism for papers will also be applied to the takehome exam. Your answers
will be submitted to a plagiarism check.
- Please also submit the declaration of ‘your own work’. The declaration can be found
in the exam folder on the student portal and can be uploaded in a separate
submission point on Student Portal. The filename should have the following format:
<owndeclaration. ixxxxxx>, ixxxxxx means your student number.

Questions can be asked until 15:30h. If we find that further clarifications are
required, these will be provided by means of an announcement on the student portal.
, - In order to download the exam and submit your answers, you will need an internet
connection.
- Make sure that you submit the four files in a Word document (your answer to
question 1, 2, 3 and your own declaration) on time (at the latest at 16:00h) via Safe
Assignments. Students who have been awarded additional exam time, should submit
the exam at 16:30h at the latest (3,5 hours exam time) or 17:00h (4 hours exam
time) via e-mail to the course coordinator Mieke Olaerts

- Please note that you can only submit once through Safe Assignments. You cannot
change your work anymore after it has been submitted (even before the deadline).
Therefore, please make sure that you upload the correct version of your document.
- We will not accept submissions via email (other than those with additional exam
time). You can only email your answers in case you encounter an error in the system
while uploading. In the event of a technical error, email your answers before the
deadline to the course coordinator m.olaerts@maastrichtuniversity.nl. Indicate in
your email what kind of error message you received while uploading and add a
screenshot of this message to your email.
- After you have submitted your exam via the submission points on the student portal,
we kindly ask you to also email it to Law-company@maastrichtuniversity.nl as soon
as possible and no later than 20 minutes after the official end of the exam. The
submission via e-mail serves as a back up; it does not count as your official
submission. If there are differences between the submission via e-mail and your
submission on student portal, the differences will not be taken into account. The
submission in student portal counts as the official submission.
Instructions with regard to the answers
- Always substantiate your answers with arguments. Your submission must reflect a
proper understanding of the course materials and an ability to make well-reasoned
arguments.
- Refer, where appropriate, to the necessary case law and/or provisions of national and
EU law. A reference to the (correct) name of the case law is sufficient. You do not
have to cite the numbers of the case law. No literature references are needed.
- Your arguments should be based on information you have synthesized and put into
your own words. Do not use quotations.
- To avoid misunderstanding: for this exam, in case it would be relevant, you will not
have to take into account the most recent changes to directive 2017/1132. You can
use the materials and the version of that directive in your legal materials reader
2019/2020 as the state of the art.
- Do not refer in your answer to answers to other questions. Include all relevant
information in full in each answer.
