When someone throws their trash away can they expect a reasonable amount of

privacy? That is the question that was before the Supreme Court in 1988. Billy Greenwood’s

attorneys argued that his Fourth Amendment rights were violated when his trash was

collected and then searched by law enforcement. The evidence found in his trash was then

used to secure a search warrant for his residence. California v. Greenwood was a landmark

case in that it finally settled the matter of whether trash set at the curb can be searched

without a warrant.


The facts of the case are this: Police were alerted to Greenwood’s possible drug

trafficking through tips given by neighbors and other informants that Greenwood may be

engaging in criminal activity (Law Library, 2020). After receiving these tips, investigator

Jenny Stracner witnessed a lot of traffic at Greenwood’s residence late at night and for very

short periods. On April 6, Stracner asked the regular trash collector to gather Greenwood’s

trash and keep then separate from the rest of the trash and to deliver the bags to her. After

a thorough search of his trash Stracner found drug remnants along with phone records

showing Greenwood making multiple calls to known drug traffickers. A search warrant was

issued, and drugs were found at his residence (Justia, 2020). He was arrested along with a

companion, Dyanne Van Houten. Both defendant’s posted bail and resumed their regular

activities. Greenwood’s trash was again collected on May 4 where more drug residue was

discovered, and a second search warrant was secured. Greenwood and Houten were again

arrested on drug trafficking charges.


Greenwood’s attorneys argued that searching his trash without a warrant violated his

Fourth Amendment, which forbids search and seizures without a search warrant, right along

with the California Constitution. The Superior Court of Orange County agreed and

dismissed Greenwood’s charges. The case was then brought before the U.S. Supreme

Court where the State’s Superior Court’s decision was overturned (Justia, 2020). It was
