Legal issues
Legal issues are different legislation acts that protect the business information. These include the
data protection act 1998, Freedom of information act 2000 and Computer misuse act 1990.
Data protection act 1998
The data protection act is a legislative act that the companies have to follow when they receive
personal data from their customers. Such a when the customers give out their details such as their
address and passwords. The employees of the organization have to make sure that they keep this
information safe and secure and make sure that it doesn’t get leaked to any other organisations or
to any third parties as this could create some serious issues. Blackburn College keep information of
the employees, students and other people that are involved in the organisation so they can monitor
information. For example, they keep data of their students such as their previous qualifications and
the attendance marks. They also take information from the teachers so they can be paid. All the
people that process personal information at Blackburn College must make sure they follow the data
protection. Blackburn College is fully committed with the data protection act; they do not pass any
information to third parties unless given the permission.
‘’The College is fully committed to the principles of data protection, as set out in the Data Protection
Act 2018. We process and maintain personal data about you so that we can manage your student
journey, submit official data to relevant government bodies, and manage your experience at
Blackburn College. In accordance with the Data Protection Act, we have a legal duty to protect any
information we collect from you. So for example, we will only use your information for the purpose as
described. We do not pass on your details to third parties unless you have given us permission to do
so, or there is a legal obligation or statutory requirement to do so. You also have the right to ask for a
copy of the information we hold about you and to have any inaccuracies in your information
corrected.’’
Freedom of Information Act 2000
The freedom of information act 2000 is provides public access to information held by public
authorities. The act is done in two ways, such as the public authorities are obliged to publish certain
information about their activities and members of the public are entitled to request information
from public authorities. The act covers all the public authorities such as the NHS, the government,
police forces and the local authorities; however there are some organisations that are not covered
by the act such as some charities that receive grants. The recorded information can be printed
documents, computer files, letters, emails, photographs and sound and video recordings. ‘’The
information provided by Blackburn College under the model publication scheme will be provided on
this website and follows the guidance document provided by the ICO. Where it is impracticable to
make information available on a website or when an individual does not wish to access the
information by the website, then the College will provide the information by another means (i.e. by
post). Information held by Blackburn College that is not published under this scheme can be
requested in writing, when its provision will be considered in accordance with the Freedom of
Information Act.’’
Computer Misuse Act 1990
‘’First introduced in 1990, the Computer Misuse Act prohibited anyone from gaining unauthorised
access to a computer, it also encompassed unauthorised modification of a computer's files.’’ The
