Geachte voorzitter en edelachtbaar college,
Ik, Sophie Geelhoed, vertegenwoordig mijn cliënt Bertus Blommesteijn, geboren op 20 juli
1980 te Purmerend. Mijn cliënt wordt verdacht van het verduisteren in dienstbetrekking van
gereedschap en materialen uit zijn voormalige werkbus, wat strafbaar is gesteld in artikel
322 Sr. In deze pleitnota zal ik eerst de relevante feiten noteren, waarna ik het gevoerde
bewijs verweer, om vervolgens de strafbaarheid van het feit en van mijn cliënt te bespreken,
om tot slot af te sluiten met de strafmotivering en de uiteindelijke straf die, naar mijn
mening, mijn cliënt verdient.
Feitenrelaas
Om te beginnen alle feiten op een rijtje. Bertus Blommesteijn, hierna genoemd mijn cliënt,
wordt ervan beschuldigd tussen donderdag 24 november 2016 06:00 uur en donderdag 8
december 2016 10:30 uur verduistering in dienstbetrekking te hebben gepleegd. Dit is aan
het licht gekomen toen zijn voormalige baas Glenn Hartkamp op 8 december 2016 om 10:36
uur aangifte tegen hem gedaan heeft op politiebureau Leiden Midden aan Langegracht 11 te
Leiden. In deze aangifte verklaart de heer Glenn Hartkamp in naam van rechtspersoon Dick
Hartkamp het volgende. Hij zou samen met een collega Lewis Vermeer op vrijdag 25
november om 06:00 de werkbus van mijn cliënt niet netjes geparkeerd op het werkterrein
