To: Les Agne, Attorney Law
Re: Potential Causes of Action for Breach of Contract and Specific Performance
In this case, Candie Cardigan, who is the representative for CARDWARE is auctioning
off her strapless giraffe print dress made of silk, satin, and velvet markings. The dress that she is
auctioning off is from a movie that they filmed in South Africa. This dress has also been
, presented among other unique famous dresses in the Silkadonia Actors Guild Museum. Cassie
has been appointed the auctioneer position for the World Wide Auction House. The price for the
dress was being sold for $5,000. During the auction two buyers, Jade and Pearl, were going back
and forth increasing prices to win the dress. Pearl appeared to win the auction for the dress and
Cassie acknowledged that and nodded her head. However, Candie that is representing her dress
in the auction told Cassie to not sell the dress to Pearl but to sell it to Jade. Pearl then goes to
Cassie and presents her with the $8,500 that she bid for the dress. Cassie then denies the money
and tells Pearl that the dress should go to Jade. Candie than explains to Pearl that Jade had
supposedly raised her paddle after Pearl bided for $8,500 and showed five fingers meaning that
she was going to bid $500 more than Pearl. In the reality of things, Jade did not do what Candie
was explaining.
Auction contracts are between the seller and buyer. In this, the seller agrees to sell a
certain item or property for the highest price to the buyer and the buyer than agrees to pay it in
full. At an in-person auction, the auctioneer gives a signal either by voice or movement
acknowledging the acceptance of the bid offered.After the acceptance of the bid the auction for
that item is closed. “When the auction completes, the seller may not refuse to sell the item for the
highest bid amount. The buyer can also not refuse to pay the price. When the bid is accepted, the
auction is complete, and a binding contract is created.” (Know, 2020) In this situation, Cassie
nodded towards Pearl showing Pearl and giving her conclusion that she has won the auction on
the dress. Therefore, since the auction was completed for that item, Pearl did the right action by
presenting the money that she bided for the dress to Cassie. Cassie then has no right to deny
Pearl of the dress even though Candie told Cassie that Jade should have it.
