Law Reform Commission:

1.1 Describe the working method of the Commission as
mentioned in your HFL1501 Study Guide. (3)



The task of the Commission is to investigate certain matters approved by the
Minister of Justice and Constitutional Development and referred to it by Parliament.
This may involve conducting research, gathering evidence, and consulting with
experts and stakeholders. In each investigation, the Commission considers the
present legal position, and the historical development of the matter under
consideration and then, after extensive research, proposes changes to the law to
bring it into line with the needs of society. Based on their research and consultations,
the commission will then develop recommendations or proposals for action. These
recommendations are typically presented in a report or other formal document, which
is then submitted to relevant authorities or organizations for consideration. The
proposed changes often take the form of a draft bill, which is then studied by
Parliament and, if approved, becomes law. (HFL1501:46)
