, INTRODUCTION

Prior to the establishment of the United Nations Guiding Principles (UNGPs) on Business
and Human Rights, firms were primarily concerned with maximising profits and decreasing
expenses. This often resulted in a disregard for the impact of economic activity on human
rights. Certain rules and regulations were in existence to protect human rights, but they were
frequently inadequately enforced. Furthermore, many firms lacked a clear grasp of their
duties in terms of human rights, and there was no common global framework for them to
follow.
The UNGPs, which were adopted in 2011 by the UN Human Rights Council altered the
dynamics of business and human rights by establishing a clear framework for firms to follow
in order to respect human rights. The foundational pillars of the UNGPs are namely three :
the obligation of the state to protect human rights, the corporate responsibility to respect
human rights, and access to remedy for victims of human rights violations (Organizing for
Success on Corporate Responsibility: The Path to High Performance, 2014)
The UNGPs made it clear that businesses must respect human rights throughout their
operations, including their supply chains, and take actions to prevent and mitigate
any adverse impact on human rights. Doing due diligence to detect and resolve human
rights issues, interacting with stakeholders to understand their concerns, and offering
remedies for any harm caused are all part of this. Since the UNGP's adoption in 2011, NGOs
and other civil society groups have played a critical role in advocating its implementation.
This paper will discuss the potential and constraints of UNGPs in helping NGOs and other
civil society organizations as a means of preventing and mitigating the negative impact of
businesses on human rights. To support the analysis, a study is given on how Coca-Cola
being a global brand was involved in the infringement of labor rights in Colombia viz.
threats, persecution, defamation, and unfair treatment.




THE POTENTIAL AND LIMITS OF THE UN GUIDING PRINCIPLES

One of the key potentialities of the UNGPs is their ability to address the accountability gap
between businesses and human rights. Accountability is the responsibility of business firms to
respect human rights and carry out due diligence to identify, prevent, mitigate, and account for
adverse human rights impacts (Wolfsteller & Li, 2022). In the past, businesses have often been
able to operate with impunity, without being held accountable for the negative consequences
of their operations on the populace. The UNGP provides a framework for businesses to assess
and manage their human rights impacts, as well as a system for addressing grievances and
remedying harms. UNGPs can help close the accountability gap and provide a common
platform for dialogue and cooperation between companies, governments, and civil society.
