For business stud ents the most pr actical and usef ul addition h as been the se ction in e ach chapter on Strategies to Manage the Legal Risks. Th ese are quick useful summ aries that students can refer to for each section of the course to help d etermine an appropriate Legal Risk M anagement Plan ( as described in Ch apter 1). Applic ations of the Text The 15e remains a comprehensive d escription of the most import ant business law prin ciples and is most appropriate for a doctrinal surv ey course in business la w. However, the changes made to the 15e allow instru ctors to easily adapt the Smyth text to other types of courses such as: - Legal envi ronment courses, - Law and ethics courses, - Selected legal topic electives. Role of the Instru ctor‘s Manual 15th Edition The manu al fills two roles: (1) a resource book for the material in the text – it pro vides further explanation of text cont ent, case summa ries and answers to qu estions, pr oblems and cases; – it also pro vides supplem ental mat erial for background and currency by referring the instru ctor to additional cases, articles and w eb mat erial not referenced in the text (some cases were decided s ince the text went to pr ess, othe rs offer depth b eyond that of the text). (2) a teaching aid – it recomm ends str ategies to t each particular material; – it pro vides a consistent t emplate to d eal with ethical theme bo xes; – it assists the instru ctor in adapting the text to a variety of leg al cou rses. Form and Content of the Manual Naturally subst antive changes to the manual mir ror the changes made to the text. The format of the manu al is familiar and larg ely unchanged from previous editions. E ach chapter contains general comm entary under headings correspondi ng to the headings within t he text chapter, suggested approaches and question answers are provided for each of the issue boxes (ethical, international, and contempor ary where appropriate), there are answers to qu estions, pr oblems and cases and fin ally case summa ries. The comm entary identif ies the compl exity of key issues from the text and identifi es strategies to teach them (teaching aid component ). This is also wh ere instru ctors will fin d referral to other resources, examples, and additional cases. Ethical Issu e: A consist ent app roach to the ethical content is import ant to the students and for the purposes of demonstr ating embedd ed ethical cont ent duri ng program accreditation ( for example AACSB). Therefore, the comm entary under Law and Business Ethi cs in Chapter 1 of the m anual describ es 6 k ey values to be used as the template for discussion of each of the ethical issues in subsequ ent ch apters. It is recommend ed that instru ctors review the commentary in Ch apter 1 ev en if this chapter is not assigned reading for students. In each subsequ ent chapter, the manu al identifies (in bold font) the r elevant ethi cal valu es presented in the issues bo x. International Issu e: These boxes take two different forms. One type involv es a factual situation that crosses a jurisdi ctional boa rder and students consid er the conflict of l aws scenario to d etermine which laws should be applicable. The other type involves compa ring the law from two ju risdictions to ev aluate the di fferent str ategic approaches taken. Most oft en the foreign jurisdi ction is the United States as this is sti ll Canada‘s major trading partner. For the first type, the m anual provides contextual background to the fact situation. For the second type, the m anual may provide additional info rmation on the l aw of the foreign jurisdictions. In both c ases, the m anual answers the questions pose d and identifi es key points that should be elicited during class dis cussion. Conte mporary Issue: Most of these boxes were removed in favour of ethical and int ernational boxes. However in a very few chapters they are retained to d eal with an especially important topic or because no ethical or int ernational issues box was applicable. Answ ers to Qu estions, Probl ems and Case s: The questions r equire students to des cribe a particular legal rule or principle and the refore the answer includes a specific page reference to the description of that rule in the text. Problems and Cas es require students to apply legal prin ciples to fact situations and th erefore specific page references are less relevant. Instead, instru ctors are referred to t he case that inspir ed the qu estion (where applicable). Case Summaries : The case summa ries provide a brief description of the cases referred to in the footnotes of the text. Major cases that are described in de tail in the text are not repeated in the manual. If the case has already been summa rized in a p revious chapter, the instru ctor will be referred to that chapter. Possible Confi gurations for Other Course Types Legal envi ronment courses tend to emphasi ze the processes and resources involved in the leg al system as well as the underlying policy considerations b ehind va rious legal prin ciples (in combin ation with some substantive l egal cont ent). Law and Ethics courses examine both stand ards of behavior. T he issue boxes in the 15th edition complim ent bo th of th ese types of courses. By approaching the chapter from the perspective of the theme bo xes the instru ctor can change the emphasis of the book to meet the course goals. Lawyers have always recognized the h uge overlap between law and busin ess, but bus iness schools are only now be ginning to comb ine busin ess and l egal education. M any schools of fer additional electives in l aw beyond t he core compulsory course. There is a void of t ext material for specific electives at the business school lev el.
