her about an irate telephone message. The nurse had a patient with her because she was taking
the patient to a room. The nurse spoke to Sue in an abrupt manner in the hallway which is
unprofessional and could cause a breach. This is a compliance issue due to the way in which
the nurse reported the complaint. Sue should work together with the compliance department to
create a procedure on how complaints are reported in the clinic. They should be reported in
person in the managers office or by email only. Sending this new procedure out to all staff and
having them sign off that they have read and understand it will help with reoccurrences. This
will help prevent abrupt complaints being reported in areas that patients or others might hear.
A second mistake in the scenario is when Sue told Mrs. Stevens to visit with her fathers-
in-law physician for any information. The physician wouldn’t be able to give any information
to Mrs. Stevens because she is not the patient but a family member. This would require a
HIPAA compliant authorization signed by the patient. This is a compliance issue. To solve
this issue Sue will need to consult with the compliance department to create scripting to help
with these type of phone calls. There needs to be education on patient privacy and
confidentiality. They could create and produce to the entire staff cheat sheets to refer to quickly
when on the phone. The law requires the consent of the patient in writing to disclose patient
health information.
A third mistake in the scenario is that Sue opened the patients medical record through the
electronic record system. Sue read about the patient’s diagnosis of prostate cancer and was in
the physicians dictated notes. Sue did not need to be in this patients’ medical record. She had
already checked in the patient management system to get the information she needed.
This is a compliance and legal issue. This is a violation of the HIPAA privacy rule and the
American Recovery and Reinvestment Act of 2009 (ARRA). The minimum necessary principle
was not followed. The compliance department and manager need to create a policy and
procedure for investigating complaints. They need to include training and procedures regarding
