o Wat is internationaal recht?
▪ = Het recht dat internationaal, tussen staten onderling, werkt
wanneer ze verdragen willen sluiten
o MAAR: moeilijke elementen:
▪ 1: Al Qaida is geen staat
• Een redelijk ongrijpbaar netwerk van actors over
verscheidene staten verspreid

Nothing in the present Charter shall impair the inherent right of individual or collective self-

o Volgens hen zo interpreteren dat de gerichte aanval enkel
uitgevoerd mocht worden door een staat
▪ Dus je mag enkel jezelf verdedigen als de gewapende
aanval door een echte staat is uitgevoerd
▪ Al Qaida is geen staat
oMaar dus als je onder de idee van wettige zelfverdediging acties
gaat verrichten op het grondgebied op een staat terwijl de staat
zelf eigenlijk niets gedaan heeft, schend je de soevereiniteit van de
staat
▪ Mag dus enkel als je zeker bent dat die staat er achter zit
▪ 2: je mag niet meer geweld gebruiken dan dat er tegen u gebruikt is
• Je mag alleen maar dezelfde hoeveelheid geweld gebruiken
• En het tegengeweld moet noodzakelijk zijn
o Aantonen dat er geen enkele andere manier was om je te
verdedigen
• Om escalaties te voorkomen
o Dag na 9/11 komt Veiligheidsraad bij elkaar

Resolutie 1368 (2001) unaniem
Reaffirming the principles and purposes of the Charter of the United Nations,
Determined to combat by all means threats to international peace and security caused by
terrorist acts,
Recognizing the inherent right of individual or collective self-defence in accordance with the
Charter,
1. Unequivocally condemns in the strongest terms the horrifying terrorist attacks which
took place on 11 September 2001 in New York, Washington (D.C.) and Pennsylvania and
regards such acts, like any act of international terrorism, as a threat to international peace
and security;
2. Expresses its deepest sympathy and condolences to the victims and their families and to
the People and Government of the United States of America;
3. Calls on all States to work together urgently to bring to justice the perpetrators,
organizers and sponsors of these terrorist attacks and stresses that those responsible for
aiding, supporting or harbouring the perpetrators, organizers and sponsors of these acts will
be held accountable;
4. Calls also on the international community to redouble their efforts to prevent and
suppress terrorist acts including by increased cooperation and full implementation of the
relevant international anti-terrorist conventions and Security Council resolutions, in
particular resolution 1269 of 19 October 1999;
5. Expresses its readiness to take all necessary steps to respond to the terrorist attacks of
11 September 2001, and to combat all forms of terrorism, in accordance with its
responsibilities under the Charter of the United Nations;
6. Decides to remain seized of the matter.

▪ Roepen ook op om de Veiligheidsraad zelf te gebruiken om acties te ondernemen
▪ Er is dus geen onmiddellijke actie door de VR
• Stellen vast wat er gebeurd is
• Zeggen dat het verschrikkelijk is en bedreiging is voor internationale
veiligheid en dat we moeten samenwerken
o 18 september in VS:
▪ President Bush krijgt toestemming beide kamers van Congres VS om alle
noodzakelijke middelen te gebruiken tegen landen, organisaties of personen die
verantwoordelijk zijn voor die aanslag

nations, organizations, or persons he determines planned, authorized, committed, or aided
the terrorist attacks that occurred on September 11, 2001, or harbored such organizations

Taliban te bevechten in Afghanistan
▪ Bombardementen en grondoorlog
▪ Wat is de redenering?
• Al Qaida, het terroristische netwerk, heeft
basissen in Afghanistan
o Osama Bin Laden, die later beschouwd
werd als de leider van Al Qaida die besliste
over de aanslagen, was op dat moment in
Afghanistan
• In Afghanistan was op dat moment het regime
van de Taliban aan de macht en zij doogden de
aanwezigheid van Al Qaida
o Maar waren er toen eigenlijk niet van op
de hoogte
o Maar ze deden ook niets tegen Al Qaida en hadden er wel
sympathieën voor
