Geldt voor iedere werknemer die in dienst is geweest na zijn 18 e en onvrijwillig wordt ontslagen.
Zowel voor de aovk bepaalde tijd als onbepaalde tijd
Ook werknemers die na UWV procedure ontslagen worden hebben hier recht op / ook via
opzegging en ontbinding
Max. €83.000,- bruto of een jaarsalaris indien dat hoger is
Let op einde door AOW-leeftijd bereiken dan geen recht op TV 7:673 lid 7 sub b BW
LET OP: vervaltermijn van drie maanden na de dag waarop de aovk eindigt 7:686a lid 4 sub b

Doel/betekenis transitievergoeding
Een compensatie voor het verlies van werk en als hulpmiddel om de overgang naar ander
werk te vergemakkelijken
Forfaitair bedrag: uitsluitend gebaseerd op laatst verdiende maandsalaris en anciënniteit van
de werknemer
Werknemer is niet verplicht op dit bedrag in te zetten voor het vinden van ander werk, maar
dan moet hij wel belasting afdragen.
Hoe wordt de transitievergoeding berekend? 7:673 lid 2 BW
Vaste berekeningswijze
Bedraagt 1/3 van het maandsalaris per vol dienstjaar
En een evenredig deel daarvan voor de periode dat de aovk korter dan een jaar geduurd
heeft

Rebecca is 45 eb heeft bij einde dienstverband vijftien jaar en 7 maanden gewerkt voor
werkgever Microsoft.
Zij verdiende €4.200,- bruto per maand inclusief vakantietoeslag
Voor volle dienstjaren → 4.200 : 3 x 15 = 21.000,-
Voor 7 maanden → 4.200 : 3 : 12x7 = 817,-
Totaal: €21.817,-
