FACTS
This action was brought by the plaintiff Don Francisco Martinez against his son Don Pedro
Martinez, the appellant, for the recovery as owner of two certain vessels, the steamship Balayan
and the schooner Ogoño. In this case it is found as a fact that the titles to the steamer Balayan
and the coasting vessel Ogoño are registered in the name of the defendant. It must be assumed
from this that the defendant has the legal title to the vessels, as without it they could not be so
registered. The findings of fact were made by the lower court and are contained in the judgment
to wit: "I am of the opinion that Don Francisco Martinez, for himself and in representation of his
