, Question 1

Upon Ayanda's demise, her and Cele's common estate will be apportioned in
accordance with the rules of intestate succession, given the absence of a legitimate
will.

1. Initially, Cele is eligible for his legal quota. The legal portion constitutes an
amount equivalent to half of the joint estate's net value, which in this instance
stands at R3,000,000, so Cele will inherit R1,500,000.

2. The leftover half of the joint estate's net value, also R1,500,000, is to be split
equally among Ayanda's descendants.

• Dan, Ayanda's child from her first marriage who has since passed, leaves
behind four children, Ayanda and Cele's grandchildren: Junior, Eve, Fiona,
and Siya. Each will inherit a quarter of Dan's portion, which results in
R375,000 each after dividing R1,500,000 by 4.

• Ayanda's three children from her second marriage to Ben - Xandi, Yvette, and
Zoya - will each receive an inheritance. As Ayanda has passed, her portion
will be equally divided among her three children, providing each with
R375,000.

• Cele's child from a previous marriage, Gerald, won't inherit any part of the
estate, being that he is not a descendant of Ayanda.

Hence, the estate will be apportioned as follows:

• Cele: R1,500,000

• Junior, Eve, Fiona, and Siya (grandchildren of Ayanda and Cele): R375,000
each

• Xandi, Yvette, and Zoya (Ayanda's children from her second marriage):
R375,000 each

This distribution must consider any remaining debts, tax liabilities, or claims against
the estate.
