Recruiting a new member of staff

Legal Issues:

The Data Protection Act -

Two legal issues that should be taken into consideration by Alton Towers when they
are recruiting a new staff member are ‘The Data Protection Act and ‘The Sex
Discrimination Act’.

When recruiting a new member of staff, Alton Towers should ensure that information
or data such as the employee’s address or phone number that is given by the new
member of staff should be protected and only those who are authorised are able to
see it. Under the Data Protection Act, it is vital that Alton Towers as a business puts
in the necessary security procedures to prevent those who don’t have authorization
from getting to the personal data of employees/staff. There are many ways that Alton
Towers could use in order to protect its staff data, one may be that it could password
protect files that contain the data of employees so only those in the human resource
department at Alton Towers will be able to look at the confidential information.

The Sex Discrimination Act -

When recruiting a new staff member, Alton Towers should also ensure that they do
not discriminate applicants on the grounds of their sex or gender. If they were to do
this then they would be violating the Sex Discrimation Act which could lead to them
being prosecuted or even being fined. For example if Alton Towers had a job ad
highlighting information in regards to a vacancy at Alton Towers but highlighted that
the job was open to men only; this could clearly be seen as a violation of the sex
discrimination act because they failed to take into consideration female applicants
who may want to apply for that job. They should ensure that they allow both males
and females to apply for the job so they are not discriminating against sex because if
they were then they would be prosecuted hence leaving their image as a family them
park tarnished.
