LA EXTINCION DE LOS CONTRATOSADMINISTRATIVOS
EXTINCION: CUMPLIMIENTO Y RESOLUCION
Art. 209 LCSP Extinción de los contratos. Los contratos se extinguirán
por su cumplimiento o por resolución, acordada de acuerdo con lo
regulado en esta Subsección5.ª
Los contratos se extinguen por su cumplimiento o por algunas
circunstancias que provocan su resolución.
CUMPLIMIENTO
El contrato se extingue por su cumplimiento, pero ese cumplimiento
no se puede hacer de cualquier forma.
A demás de ejecutarse y cumplirlo a tenor de las cláusulas, la ley
prevé que dicho cumplimiento tiene que ser a satisfacción de la
administración contratante.
¿Como se refleja que la administración queda satisfecha? Surge un
procedimiento nuevo que es la fase de la recepción del contrato.
Este procedimiento de recepción se realiza por el órgano de
contratación correspondiente, y a veces tiene que intervenir un
órgano de control si es necesario.
El acto de recepción es un acto formal mediante el cual la
administración concluye que la ejecución del contrato se ha realizado
correctamente. Esto se hace por medios de inspección y control.
Si se ejecuta correctamente el procedimiento termina; pero si el
objeto del contrato no esta preparado para su recepción es cuando
hay problemas. Lo que surge son las penalidades, la administración
se puede quedar con la garantía o si los incumplimientos son tan
graves puede propiciar la resolución del contrato.
Una vez realizado el acto formal de recepción, a partir de este
momento empiezan a correr los plazos para el pago del contrato. Y a
parir de aquí se produce la liquidación del contrato.
RESOLUCION
La ley a partir del 209 incluye circunstancias que provocan problemas
de carácter físico y jurídico:
muerte o incapacidad sobrevenida del contratista
extinción de la personalidad jurídica de la empresa
la declaración en concurso o insolvencia del contratista
resolución de mutuo acuerdo
