DISCRIMINATION & ETHIC THEORIES 2 Introduction Throughout recorded history, discrimination in varied forms have plagued this nation from the onset and we as a human race should better understand how this fourteen letter word(discrimination) serves only to divide, humiliate and violate anyone/anything it comes in contact with. Gender discrimination is one such act and is defined as any action that specifically denies opportunities, salary/wages, benefits, or promotions to a person based on gender (Zipfel & Kleiner, 1998). This type of morally wrong behavior can be seen in the case of Ledbetter vs. Goodyear Tire & Rubber Co. Lilly Ledbetter, who was hired in 1979 and worked for the company at their plant in Gadsen, Alabama for twenty years as the only female production supervisor. She filed a charge of discrimination, shortly before her retirement, with the EEOC sighting various forms of sex discrimination after she was involuntarily transferred or in my opinion demoted to a not so prominent job on the production floor (Brake & Grossman, 2007). Although a jury ruled in her favor and awarded her over 3 million dollars in punitive damages, the judge reduced that amount to 360,000 in accordance with Title VII’s cap on damages (Brake & Grossman, 2007). Ledbetter would never get to see one penny of her awarded amount due to Goodyear’s appeal in which the judgment/verdict was thrown out based on a 180 day rule with the Title VII’s statute of limitations (Brake & Grossman, 2007). The economic theory of capitalism fits this business in that the company is acting on personal self-interest (not community interests), which motivates the business activity (Fieser, 2015). After all, the main purpose of Goodyear is to earn a profit even if that profit is at the expense of others, in this case, their employees.
