Group is men voornemens om vanuit Distribution
Corp een distributiecentrum op te zetten in België
van waaruit de producten van Apparel Group binnen
de EU worden verspreid. Laten we voor het
voorbeeld even aannemen dat Distribution Corp
vanwege zijn Amerikaanse vestigingsplaats in België niet in aanmerking komt
voor een bepaalde aftrekpost, en dat binnenlands
vennootschapsbelastingplichtigen in België deze aftrekpost wel krijgen.
Gevraagd:
a. Kan Distribution Corp een beroep doen op de bescherming van de EU-
verdragsvrijheden in een poging op basis van non-discriminatieargumenten alsnog
de aftrekpost te krijgen? Of kan België de vennootschap toegang tot de vrijheden
weigeren?
