DELITO.
Un delito es un acto ilícito sancionado con una pena. Existen dos tipos:
Delito público: Es una violación de una norma jurídica de importancia
social perseguida y castigada por el Estado.
Delito privado: Es una ofensa ocasionada a un particular castigada con una
pena pecuniaria.
OBLIGACIONES EX DELICTO.
Las obligaciones ex delicto son aquellas que nacen de los delitos y se clasifican
en hurto, rapiña, injuria y daño injustamente causado. Se caracterizan por:
La intransmisibilidad: No pueden transmitirse a los herederos.
La acumulación entre delincuentes: Para aquellos casos en los que el
delito ha sido cometido por varias personas
La acumulación procesal: La acción penal es compatible con el ejercicio de
otras acciones dirigidas a la obtener la restauración del daño sufrido o de
la cosa robada.
