MATRIMONIO.
El matrimonio es la unión de dos personas del sexo opuesto con la intención de
ser marido y mujer. Es una situación jurídica fundada en la convivencia conyugal
y en la affectio maritalis. No es necesaria una convivencia efectiva y puede
contraerse en ausencia del marido pero no de la mujer.
Los requisitos del matrimonio son:
La capacidad natural: No pueden contraer matrimonio los impúberes.
La capacidad jurídica: Se precisa ser libre y ciudadano.
El consentimiento de los esposos: No puede contraer matrimonio el loco ni
se tiene por valido el contraído por violencia.
El consentimiento del paterfamilias: Sólo en el caso de que los
contrayentes sean sui iuris.
Los impedimentos al matrimonio son:
Absolutos (producen incapacidad para contraer matrimonio en cualquier
caso):
El matrimonio precedente todavía no disuelto.
La esclavitud de uno de los cónyuges.
El voto de castidad y las órdenes mayores.
Relativos (producen incapacidad para contraer matrimonio con referencias
a determinadas personas):
El parentesco de sangre o cognación o adopción.
El parentesco espiritual.
La afinidad.
El adulterio y el rapto.
Otras razones especiales de varia índole (matrimonio entre
cristianos y judíos, matrimonio de militares, etc.).
Los efectos del matrimonio son:
El marido y la mujer no están en situación de igualdad, sino que ésta está
subordinada al primero. Esto trae como consecuencia que la mujer y no el
marido sea castigada por adulterio, que al marido le compete la defensa
de la esposa en caso de producirse ofensas sobre la misma y que el
marido puede reclamar la mujer a todo tercero que la tenga retenida
indebidamente.
