An employment contract is defned y the UK government as ‘a contract is an agreement that sets
out an employee’s employment conditonss rightss responsi ilites and dutes’’ onditons of a
contract should e included as these tend to set out the hours which a worker will work as well as
the days which will e worked’ Rights of the jo should e included as without theses the worker will
not know the enefts they will gain from the employer’ These can e assumeds such as a working
week elow 48 hourss or may e writens such as private health insurances or increased holiday tme
if the worker stays with the company for a length of tme’ Responsi ilites and dutes are essental
for an employment contract as without thiss the workers will not e legally responsi le for their roles
and can refuse to do any jo s statng that they were not writen in the contract’ This also helps to
protect the employee y giving them a comprehensive list of all their roless helping them to know
what they should and shouldn’t e doing when at work’ An employment contract may also include a
non-competton clause’ These are writen to protect the usiness from a worker who will atempt to
swipe customers of the usiness’ This can include a garden years which includes the worker staying
at home with pay for a certain amount of tme so they lose contacts as well as them forgetng some
of the usiness practces’ This is used as without this the worker may swipe customers from the
companys making the company lose money’ A confdentality agreement is used to ensure the
workers are not going to legally give facts and trade secrets of a usiness to a compettor who may
e looking to decrease the gap etween the two companies’
These are also called the ‘terms’ of the contract’ These terms can either e express termss which are
writen inside the contracts or implied termss which are not writen down ecause of the
o viousness of them’
Employment contracts are important for oth the employer as well as the employee’ This is ecause
it clearly spells out what jo s the employee must undertakes which can help oth the employee and
employer if there is a disagreement over jo s’ In additons it can help the employer y providing
security if a worker is looking to leave and take customers with them’ In additons they will help
employees as they cannot e fred without a certain amount of knowledge and possi ly
compensaton’
Employment contractss therefores are important for oth employers and employees’
