Week 3

- COMLAW PART
- Information privacy rules (privacy act)
These rules have broad principles that lack precision on speci c rules, this is an advantage of
exibility and future-proo ng them against technological changes. The act addresses the
empowering of the Privacy Commissioner (PC) that deals with systemic issues through issuing
compliance notices against agencies.

The Act is a one-size- ts-all all model that applies the principles to most sectors. This Act and the
PC empower the Codes of Practice for some sectors in some cases which replaces the rules in
the Act.

The Act has 13 privacy principles that are to international standards.

Anyone who holds personal information about someone is classed as an agency (businesses and
individual trader) and are held under Act laws. Agencies can only collect information if the
purpose of collecting is necessary, lawful, and that the information taken is known by the person it
is taken from.
The business must also have reasonable security in place to prevent loss, if they do have
reasonable security and information gets stolen they are not to blame but they must tell the
person what happened. If they don’t have reasonable security then they are to blame.

fl fi fi fi fi fi fi

, The courts will decide if the information taken is fair and taken within lawful rights, if the defendant
approaches privacy commissioner, who if they consider there to be a breach they will go to the
human rights director and tribunal .

- GDPR vs Privacy act
GDPR = standardised law across 27 member states of the EU. Leading examples of data privacy
law.

Privacy Act = act in 2020 is NZ privacy law is it an evolution from NZ privacy act of 1993 which is
one of the earliest data privacy laws.
